Terms and conditions
This English text is provided for convenience. The Dutch version is legally authoritative. Algemene voorwaarden
In brief
- Work starts after a written quote, your acceptance and a 40% deposit.
- Free reschedule or cancel more than 7 days before the session; later rules apply in article 6.
- Mix/master includes 2 revision rounds; session files kept 24 months.
- Consumers may have a withdrawal period where EU rules apply; see article 7.
1. Scope
These terms apply to all engagements between Nephilimrivo B.V. (the studio) and the client for recording, mixing, mastering, podcast capture and related services at Overtoom 289, Amsterdam. Changes are valid only when written in a quote or order confirmation.
The studio operates nephilimrivo.click. Company details are in the legal notice. Accepting a quote means you acknowledge these terms. Business clients confirm they are authorised to bind their organisation.
2. Definitions
| Term | Meaning |
|---|---|
| Quote | Written proposal with scope, date, VAT-inclusive price, deposit and any special terms. |
| Session | Reserved studio time with an engineer, or agreed offline mix/master work. |
| Consumer | Natural person acting outside trade, business or profession. |
| Business client | Legal entity or person acting in trade or profession. |
| Materials | Recordings, session files, mixes, masters and other audio delivered. |
3. Quotes, contract and age
A request via contact, email or phone leads to a quote we normally send within 2 business days. A quote stays valid until the expiry date shown on it. The contract is formed when you accept the quote in writing (email is fine) and the agreed deposit reaches our account.
We may decline work where safety, scheduling or rights conflicts arise. Minimum age to book independently is 16; younger artists are welcome with written guardian consent and an adult present throughout the session.
4. Prices and VAT
Guide prices on services include 21% VAT. Examples: Vocal recording from €115 per hour or €420 half day; Band and live recording €145 per hour; Mixing €195 per song; Mastering €89 per track; Podcast recording €125 per hour. The quoted amount governs.
Extra session time is invoiced by agreement at the hourly rate on the quote, per started half hour. Business invoices also show net amounts (e.g. €95.04). Planning notes live in guides such as vocal session checklist and mix turnaround planning.
5. Deposit, payment and default
When booking you pay 40% of the quoted total as a deposit. The balance is due on invoice date: for consumers usually before or on the session day; for offline mix/master on delivery of final files. Business clients pay within 14 days of invoice unless agreed otherwise.
Late payment may attract statutory commercial interest and reasonable collection costs. Until full payment we may withhold final exports; raw session files follow the archive rules in article 9.
6. Cancellation and rescheduling
| Timing | Effect |
|---|---|
| More than 7 days before | Free cancel or one reschedule; deposit refunded or moved. |
| Within 7 days | Deposit remains due; one reschedule within three months by agreement. |
| Same-day cancel or no-show | Full session fee due unless we resell the slot. |
Send requests in good time to [email protected] or 020 244 8916. Arriving late shortens session time without discount when the next block is booked.
7. Right of withdrawal (consumers)
If you are a consumer and conclude a contract at a distance (email/phone/form), you generally have 14 days after conclusion to withdraw without giving reasons, under EU consumer rules. That right ends when you explicitly ask us to start before the period ends and confirm you lose the right once the service has been fully performed.
Services on a fixed date or period (typical studio sessions) may follow additional rules. Where unclear, we explain the regime in the quote. Withdraw by writing to [email protected]; refunds due by law are paid within 14 days.
8. Running sessions
Sessions run within Tue–Fri 11–22, Sat 12–18 by appointment. We provide 8 headphones and 4 nearfield pairs as planned. Follow engineer instructions for safety and listening levels. Smoking and vaping inside the studio is not allowed.
Damage to studio gear caused wilfully or by gross negligence by you or your guests is charged to you. Instruments and amps you bring remain your risk; insure them if needed. We may pause or stop a session when safety is at risk.
9. Delivery, formats and archive
Unless the quote says otherwise, we deliver stereo files in common lossless formats via secure download. Stems or alternate formats are quoted separately. Offline mix/master timelines start once complete, usable sources and clear notes arrive.
We keep session and project files for 24 months after the last relevant activity, then delete unless you buy extended storage in writing. You are responsible for backups after receipt. See also master delivery formats.
10. Revisions
Mixing and Mastering include 2 revision rounds as described on the service pages. One round means one consolidated feedback list processed in one pass. Extra rounds or a new artistic direction after approval are quoted separately at €95 per attended hour or a fixed fee by agreement.
Book attended time via contact; remote notes use agreed channels. Silence longer than 24 months may mean project files were already cleared.
11. Intellectual property
You retain ownership of compositions, lyrics and performances you supply. You warrant you may record and mix what you bring, including samples and covers, and that you handle collective-management payments where required.
After full payment the studio grants you a licence to use the recordings and mixes for the project purpose. We claim no co-authorship. We do not use your material in portfolios or social posts without written consent. Voice recordings are not used for AI training or cloning without separate written permission.
12. Liability
The studio owes a duty of care: we work to professional standards, yet artistic judgment stays subjective. Our liability for direct loss is capped at the invoice total for that job, except where law forbids (intent, recklessness or personal injury).
Indirect loss, lost profit, data loss after handover, or damage from misuse of files is excluded where permitted. The site disclaimer adds limits for non-contractual information.
13. Personal data
We process personal data for quotes, delivery, billing and support under the privacy policy. Contact forms may route through FormSubmit (US); see the legal notice. Business clients supplying guest or musician data sign our data processing agreement where needed.
14. Complaints, law and courts
Complaints about delivery or invoices should reach [email protected] within a reasonable time with a short description and relevant files. We respond within 2 business days with a proposal.
Dutch law applies. EU consumers may also use courts in their country of residence where directives allow. For business disputes the competent courts in Amsterdam have exclusive jurisdiction unless mandatory law says otherwise.
15. Changes and version
We may update these terms for new jobs. The version dated 15 October 2026 applies to quotes you accept afterwards. Material changes are flagged to returning clients by email or on the site. If languages diverge, the Dutch text prevails.
